Removal of Racially Restrictive Covenants


Government Code §§ 12956.1, 12956.2, 27282, 27388.1, 12956.3, and 27388.2


The removal of racially restrictive covenants were assist by several Governmental Code provisions. To remove racially restrictive covenants, a title insurance company involved in any transfer must identify if a deed or other document contains unlawful restrictive covenants and modification form must be recorded with the county recorder. As of July 2022, any person, regardless of whether they hold an ownership interest in the property can record such a modification document. County recorders must record any such modifications after consulting with county counsel to confirm that the covenant is unlawful.
